GENERAL CONDITIONS
This General conditions settles the relations between “ALEXIS.BG” LTD as a supplier and its customers as users of the internet site of the supplier – www.Alexis.bg. Alexis is a trade mark and everywhere in these General conditions Alexis means the holder of the trade mark Alexis.BG LTD.
1.1. 1.2. The user declares that he/she is familiar with these General conditions and by clicking on any link, button, image or application located on the web-site www.alexis.bg the user expressly and unconditionally agrees with them.
1.3. Alexis reserves the right to change the design of www.alexis.bg, its content and the current General conditions at any time. The changes become valid at the time of their execution/publishing at www.alexis.bg.
The terms used in these General have the following meaning: Internet site is a aggregate of web pages with a common header internet page which loads in your browser upon typing the address www.alexis.bg. User of www.alexis.bg is every person who entered or reached the address www.alexis.bg by redirecting from another website to make purchases of goods electronically. User with registration is every person who did actions specified by Alexis.bg, as a result of which he/she enters in the database of Alexis.bg and can make checks on his/her history of the orders in www.alexis.bg. User with quick order is every person who did actions specified by Alexis.bg, to make order of goods at www.alexis.bg, without registration and is not entered in the database of Alexis.bg. Browser – computer program which provides opportunity for transmission, processing and visualization of data through different types of protocols for data transmission. Malicious actions are actions or inactions violating the internet ethics or causing damages to persons connected to internet or associated nets, sending unsolicited mail (unsolicited commercial messages, SPAM), gaining access to resources with foreign rights and passwords, using flaws in systems for personal benefit or to obtain information (HACK), performing actions that can be qualified as industrial espionage or sabotage, damaging or destroying information databases (CRACK), sending “Trojan horses” or causing installation of viruses or remote control systems, disturbing the normal operation of other users of internet and associated nets, carrying out any activities whatsoever which may be classified as crime or administrative offense under the Bulgarian legislation or other applicable legislation. User profile is a separate part of www.alexis.bg containing information about the user - e-mail address and password through which are accessable the services provided by Alexis.bg and an exchange of information between the user and Alexis.bg is performed; Contract for distant selling – any contract concluded on the basis of a proposal from Alexis.bg and an user as a part of a system for sale of goods or provision of services where from the date of submission of the proposal to the conclusion of the contract the parties are not in physical contact with each other. Each separate order represents a separate contract. III. Confidentiality of the provided data
3.1. The personal data that Alexis.bg receives upon registration or concluding a contract for sale without registration, shall only be used for customer service – accepting and execution of orders and connection with the customer in case of problems related to the order.
3.2. Alexis.bg fulfills the requirements of the Law on protection of personal data and is responsible for protection of the information about the user that become known to them on the occasion of the conclusion of the distant contract, except in cases of force majeure, random event or malicious acts of third parties.
3.3. By accepting the General conditions the user agrees that his information to be stored and processed in the manner provided by the law and agrees that the personal data to be accessible in his/her user profile at www.alexis.bg as well as to be used by Alexis.bg for direct market purposes.
3.4. Alexis.bg undertakes not to disclose any personal information about the user and not to provide the collected information to third parties – government authorities, physical persons and others unless: - upon express consent of the user obtained during the registration or at a later time; - the information is required by governmental authorities or officials who, according to the current legislation, are entitled to request and collect such information in compliance with the statutory procedures; - other cases specified by law.
3.5. By the registration in www.alexis.bg the user agrees that Alexis.bg may send personal, advertising or other commercial messages to the email specified by him/her.

4.1. When using the web page of Alexis.bg the user is responsible for all consequences resulting from his/her conduct including for all property, intellectual, electronic or any other nature or kind of damages caused to the web page, the services, Alexis.bg or any other person with which Alexis.bg has a contract for joint activity or provision of service under the Bulgarian legislation.
4.2. The website is addressed to users without or with registration. The possibility of online ordering is available for users residing in Republic of Bulgaria and abroad. Persons under the age of 18 are not allowed to make statements and conclude contracts within the meaning of these General conditions. By sending an order and/or creating a profile the user declares that he/she is an adult (a person over 18).
4.3. By accepting these General conditions the user is notified that the whole content including but not only images, text and/or multimedia content, design, software, databases, information and any other content published at www.alexis.bg are property of Alexis.bg.
4.4. The user may not copy, transfer, change, use, display, provide, etc. the content of www.alexis.bg without the express written consent of Alexis.bg unless the use is non-commercial.
5.1. The user has the right to order all goods shown at www.alexis.bg. Upon carrying out the order the user is entitled to choose the type, make and model of the goods and their quantity, payment conditions, the manner and terms of delivery according to the possibilities offered at www.alexis.bg. When performing an order the user enters into contractual relations with Alexis.bg for purchase-sale of the chosen item, governed by these General conditoins. The contract for distant sale between Alexis.bg and the user is considered as concluded from the moment of confirmation of the specific order by Alexis.bg.
5.2. The on-line system for purchases through the site reflects the availability of the items as of the time of viewing and given the dynamics of the sales it is possible that certain products published and listed on the site as “available” at the time of the order to be depleted and could not be ordered/confirmed and delivered by Alexis.bg.
5.3. All orders received on Friday night, Saturday or Sunday, or during official holidays, will be processed on the first working day thereafter.
5.4. The payment of the contract price shall be made according to the methods specified at www.alexis.bg and with the payment the user makes a voluntary statement that he/she agrees to pay the product and agrees with the General conditions.
5.5. The prices of the products listed at www.alexis.bg are final prices and with VAT included. The delivery cost is paid by the user and upon ordering its value shall be shown, unless otherwise stated.
5.6. Alexis.bg reserves the right to change the prices of the products as well as the prices of the delivery.
5.7. The payment shall be made by cash on delivery – upon delivery of the ordered product
6.1. The delivery of a product ordered through www.alexis.bg is done with courier company ECONT to the address specified by the user. The "Test before you pay" option is available on orders. In case you take advantage of this option and cancel the order, you owe the courier the fee for its return. The standard delivery between 1 and 3 products, but not more than 1 kg, costs between 5-11 BGN, the delivery option ( to an office or address). The delivery costs of an order up to 3 kg cost between BGN 5-11, depending on the type of delivery chosen by the Client. The indicated prices are approximate. They concern deliveries made on the territory of the Republic of Bulgaria, which do not meet the conditions to be free of charge.
6.2. Delivery costs are paid to the courier upon delivery, unless it is free.
6.3. Orders for Sofia and the country are processed within 4 - 14 working days, in the period from 9 to 18 hours.
6.4. Upon delivery, the recipient signs a bill of lading, which certifies the exact execution of the order. The receipt for the orders is issued by the courier of the courier company Speedy or Ekont, upon receipt of the order.
6.5. Alexis.bg provides an opportunity for international orders for which apply these General conditions. International deliveries are carried out by the courier company DPD. VII. Complaint. Order cancellation
7.1. Complaints in case of obvious defects are filed within 14 days after the purchase of the goods. Complaints are not accepted in case of attempted damage and defects that are due to improper use and maintenance or are caused intentionally. Complaints are not accepted when: the returned product is not labeled, does not have a good commercial appearance, must not be worn, washed, ironed, torn, be clean, without side odors (such as creams, perfumes or cigarette smoke). The following must be attached to the consignment: goods receipt or receipt issued at the time of purchase. In case of cancellation of the order, the customer pays for the courier service to ALEXIS.BG. The costs of returning a product related to a complaint and sending a new product are at the expense of the consumer. The products with complaints are sent to the address:Econt’s office. 7.2. In the event of a defect that can be rectified and only if the problem is not the result of improper operation, items are repaired within 30 days and sent by courier at the expense of the customer. In connection with the observance of your rights and observance of the Consumer Protection Act, it is important to know that:
Art. 112. (1) In case of discrepancy between the consumer goods and the contract of sale the user is entitled to a claim by asking the seller to make the product in accordance with the contract. In this case the user can choose between repair of the product or its replacement with a new one unless it is impossible or the way of compensation chosen by the user is disproportionate compared to the other. (2) It shall be considered that a given way is disproportionate if its use imposes costs on the seller which in comparison to the other way of compensation , are unreasonable taking into account: 1. the value of the consumers goods if there was no discrepancy; 2. the significance of the discrepancy; 3. the possibility to offer the user another way of compensation which is not associated with significant inconvenience.
Art. 113. When the customer’s goods do not conform to the contract of sale the seller is obliged to bring them into line with the contract of sale. (2) Bringing customers goods into conformity with the contract of sale must be done within one month from the filing of the claim by the user. (3) After the deadline under par.2 the user is entitled to cancel the contract and be reimbursed the amount paid or request a reduction in the price of the customers goods. (4) Bringing the customers goods into conformity with the contract of sale is free for the user. He/she bears no costs for shipping customers goods or materials and works related to their repair and should not suffer significant inconvenience. (5) The user may request compensation for damages due to the discrepancy.
Art. 114. (1) In case of discrepancy of the customers goods and the contract of sale and if the user is not satisfied with the resolution of the claim under art.113, he/she may choose one of the following options: 1. termination of the contract and refund of the amount paid by him/her; 2. reduction of the price. (2) The user cannot claim a refund or reduction of the price of the goods when the trader has agreed to replace the goods with new one or repair it within one month from the filing of the user’s claim. (3) The trader is obliged to satisfy the request for termination of the contract if after having satisfied three complaints of the user through repair of the same product within the guarantee period under art.115, there is a subsequent occurrence of discrepancy of the goods and the contract for sale. (4) The user cannot claim cancelation of the contract if the discrepancy of the goods with the contracts is negligible.
Art. 115. (1) The user can exercise the right under this section within two years from the delivery of the goods. (2) The term under par.1 shall be suspended for the period required for the repair or replacement of the goods or for reaching an agreement between the seller and the user to resolve the dispute. (3) The exercise of the customer’s right under par.1 is not linked to any other term of a claim other than the term under par.1. The quoted articles are taken from the Law on customer protection.
7.3. If the user receives a product which does not meet the desired size the user has the right to return the product for a replacement with the same one but with different size and the costs for returning and resending are borne by the customer.
7.4. In case of non-compliance of the ordered goods with the sales contract and when the consumer is not satisfied with the resolution of the complaint, he has the right to choose between one of the following options: cancel the contract and request a refund or request a price reduction. The consumer cannot claim a refund of the amount paid or a reduction in the price of the goods if Alexis.bg agrees to replace the goods with a new one or to repair the goods within one month of the complaint by the consumer. Alexis.bg will satisfy a request for cancellation of the contract and will refund the amount paid by the consumer to the bank account of the consumer, when after satisfying three complaints to the consumer by repairing the same product, within the period under Law, and there is a subsequent occurrence of non-compliance of goods with the contract. The consumer cannot claim for cancellation of the contract if the non-compliance of the goods with the contract is insignificant.
7.5. Refusal of an order Pursuant to Art. 50 of the Consumer Protection Act. A consumer who has the quality of such in the sense of the Law, has the right to withdraw from the distance contract without stating a reason and without paying any costs, except for the costs, in Art. 54, para. 3 and Art. 55 of the Law, within 14 days from the date of acceptance of the goods by the consumer or by a third party other than the courier. The right of withdrawal may be exercised only if the following conditions are compulsorily fulfilled: the purchased goods must be in their original packaging, original packing without any signs of use or loss of commercial view and accompanied by all documents received with the product in accordance with the provisions of art. 55 of the Law on customer protection. The transport costs for returning the goods from the consumer to Alexis.bg are at the expense of the consumer, as the return is done through courier companies SPEEDY and ECONT. Alexis.bg refunds to the consumer the amount paid by him for the returned goods to the consumer's bank account no later than 30 working days from the date on which Alexis.bg received the shipment, and the transfer of the amount may take 2-3 days depending on the card issuing bank. Returned cash on delivery items are not accepted!
The transport costs related to delivery, replacement, return or complaint of a product purchased from ALEXIS.BG are solely at the expense of the user. All shipments sent to ALEXIS.BG at our expense will be refused or returned to the sender, unless they are individually agreed with our associate.
7.6. Where the consumer exercises his right to withdraw from the distance contract, the consumer must send or deliver the goods back to the trader or a person authorized by him without undue delay and no later than 14 days from the date on which the consumer notified the the trader for his decision to withdraw from the contract. The deadline is considered met if the consumer sends or delivers the goods back to the trader before the expiry of the 14-day period. When a consumer returns goods purchased from www.alexis.bg with courier companies SPEEDY and ECONT, the amount for the goods is refunded to the consumer's bank account after the shipment is opened and it is established that the goods meet the requirements specified above in item 7.1 . If the product does not meet the above, it is returned at the expense of the user to the address from which it was sent to Alexis.bg
VIII. Disputes and complaints
8.1. In situation arising in connection with outstanding issues the customer has the right to address these issues to our assistant at the indicated correspondence address.
8.2. Any disputes that may arise between Tendenz and an user will be resolved by mutual agreement. If this is not possible they will be referred to the competent Bulgarian court in accordance with the Bulgarian legislation.
